Superannuation is now the wealth accumulation vehicle of choice for many people. There are a number of important issues that advisors need to be aware of concerning the 'back end' of superannuation and the interaction with a person's Will. The aging of trustees and ultimately the death of a member raises particular concerns (especially in the context of an SMSF) as to who ultimately controls and benefits from the member's super. The issues confronted can be both factually problematic as well as difficult to reconcile with the member's succession objectives. If not appropriately considered and dealt with, the resulting outcome can be both unintended and catastrophic. This event examined relevant issues in detail and identified the planning opportunities and pitfalls in this area.
